Why is the I-130 Affidavit Important?
Basically, an affidavit is proof of your bona fide marriage. This acts as supporting evidence that demonstrates the affiant’s point of view of how the affiant really knows the couple or how the couple interacts with each other—leading to finding that the couple really have real marriage.
In addition, the affiant also has to provide a short account of why he or she believes that is true. Even though an affidavit shouldn’t be authorized, it must include a sworn statement, e.g., “I swear that ……”
Before acceptance of a citizen of the United States, USCIS will be looking for factual testimony about the details of the couple to prevent an I-130 application for a spouse with a fake marriage.
The fake marriage here is when one of the parties or both parties entered into the marriage for the purposes of circumventing immigration laws in order to obtain a fake green card. If you file the I-130 application with a fake marriage, it can result in harsh penalties, including jail time and fines.
What Should Be in the 1-130 Affidavit?
The I-130 affidavit is an affiant’s chance to tell his or her experience in getting to know the couple and also their marriage. It really acts as a legal statement from a third party describing your relationship. The person who becomes an affiant should be a close confidant who is familiar with the couple’s life together.
To support the primary evidence, it’s highly recommended that you submit 2-4 affidavits. In addition, you may also need to provide one or more documents to USCIS to prove that your marriage was entered into in good faith.
The following are the basic points that should be covered in an affidavit:
- Affiant’s personal information such as full name, address, date and place of birth.
- The relationship between the couple, either wife and husband.
- The explanation of how the affiant knows the couple.
- Time frame an affiant has known the couple.
- Frequency with which an affiant sees the couple.
- Details information how an affiant got this knowledge, e.g., friends.
