Securus eMessaging offers family and friends to communicate with an incarcerated loved one using email. It will allow the users to send a digital message with the option to include a photo. All messages are going to flow through the eMessaging facility portal for analysis, review and release to the intended party. Now, we will explain about Securus eMessaging Terms and Conditions.
Securus eMessaging Terms and Conditions
Here are Securus eMessaging terms and conditions:
- The customer is solely responsible for reviewing and approving each message, including any attachments (if applicable and permitted by Customer).
- The customer must comply with all laws and government guidelines applicable to Customer’s access and use of information obtained in connection with or via the Securus eMessaging Application. The customer acknowledges and understands that he/she is solely responsible for its compliance with such laws, and that Provider does not make representation or warranty as to the legality of the use of the Securus eMessaging Application or the information obtained in connection therewith. Provider will have no responsibility, obligation, or liability for Customer’s compliance with any and all laws, regulations, rules, policies, or other requirements applicable to Customer by virtue of its use of the Securus eMessaging Application.
- Provider will utilize machine translation to translate eMessages written in Spanish into English for the sole purpose of Customer review. The customer acknowledges that machine translation is not 100 percent accurate and that such machine-translated messages may contain grammatical and other errors. Provider does not make representations or warranties about the accuracy of such machine translation.
- The customer acknowledges that the information available via the Securus eMessaging Application includes personally identifiable information, and that it is the Customer’s obligation to keep all accessed information secure. Thus, Customer will:
(a) restrict access to the Securus eMessaging Application to those law enforcement personnel who need to know as part of their official duties.
(b) make sure that its employees get and/or use information from the Securus eMessaging Application only for lawful purposes and transmit or disclose any information only as permitted or required by law.
(c) Always keep all user identification numbers confidential and also prohibit the sharing of user identification numbers;
(d) use reasonable efforts to monitor and prevent unauthorized access to or use of the Securus eMessaging Application and any information derived therefrom whether in electronic form or hard copy.
(e) notify Provider of any such unauthorized access or use that Customer discovers or otherwise becomes aware of. - Customer acknowledges and understands that the Securus eMessaging Application and all information used and obtained in connection with the Securus eMessaging Application is AS IS. Provider has not no liability to Customer for any loss or injury arising out of or in connection with the Securus eMessaging Application or Customer’s use thereof. If, notwithstanding the foregoing, liability is able to be imposed on the Provider. Customer promises that he/she will not seek to recover from Provider an amount greater than such sum. Provider does not disclaim any warranty, express or implied, with respect to the eMessaging Application. Provider does not guarantee the correctness, completeness, legality, merchantability, or fitness for a particular purpose of the Securus eMessaging Application or information obtained in connection therewith. Provider is not responsible for any indirect, incidental, or consequential damages incurred by Customer from receipt or use of information obtained in connection with the Securus eMessaging Application or the unavailability thereof.
The customer hereby agrees to protect, defend, indemnify, and hold harmless Provider from and against any and all costs, demands, claims, damages, losses, and liabilities arising from or in any way related to Customer’s, friends and family members’, or incarcerated individuals’ use of the Securus eMessaging Application or information obtained in connection therewith.
